Vacation Rental Terms and Conditions
Short-Term Rental Agreement
The renter (also referred to as "you" or "the guest") will be entering into short-term rental agreement (a contract) with Harborfields, LLC, PO Box 524, West Boothbay Harbor, Maine 04575 (also referred to as “Harborfields,” “we,” or “us”) for the rental of a specified cottage located at 24 McKown Point Road, West Boothbay Harbor, Maine, furnished and equipped as described at harborfields.com, inclusive of utilities, for an agreed-upon period of time, in exchange for payment of a rental fee or other agreed-upon consideration.
For most of the season, the standard rental period is one or more weeks, beginning at 3:30 PM on a Saturday and ending at 9:30 AM on a following Saturday.
By making a reservation and paying the necessary deposit, the renter agrees to be bound by all terms and conditions outlined in this document. This contract is governed by the laws of the State of Maine, and any applicable Federal law.
Payment, Cancellation, Refunds
A deposit of at least 25% of the cottage rental fee is due immediately to confirm the reservation. The dates and cottage requested by the renter are not guaranteed until payment of this deposit. The balance (including the remainder of the cottage rental fee, Maine lodging tax, and any pet fee or boat moorage if applicable) is due upon or prior to arrival. Payment may be made in cash, or by personal check, traveller's checks, bank money orders, or cashier checks. If necessary payments can also be by credit card and online via PayPal, although accepting these forms of payment costs us more, so we would prefer cash or check.
The rates specified in this contract are the applicable rate advertised at the time of booking. The rates that Harborfields advertises are subject to change. By making this reservation, you agree that you are not eligible for any lower rates, discounts or other special deals advertised subsequent to the confirmation of this reservation, nor shall you be required to pay any increased rate above that specified in this contract.
In the case of cancellation or early departure, for any reason, deposits and any other monies paid are refundable only if we succeed in renting the cottage to someone else for the vacant period, at the same rate. A partial rental, or discounted rental, would result in a partial refund. However, if the cottage remains vacant, there shall be no refund at all.
Occupants
Note that the cottages have a maximum occupancy as outlined below. Additional overnight guests in excess of these numbers are not permitted. Tents are not allowed.

ADDITIONAL CONDITIONS
Please, no smoking inside the cottages. If you must smoke, please do so outside and properly dispose of cigarette butts.
Do not leave fires in fireplaces, woodstoves, or grills unattended. Only use grills outside the cottages, and please clean all up grease and food spills.
During your occupancy, we will not clean in the cottages, wash dishes, nor change or make beds. You may exchange soiled towels or linens for clean ones by bringing them to the linen shed, but please understand that our supplies are limited. Upon departure, please leave the cottage in a tidy state, including having washed any dishes.
Please keep the cottage and all furnishings and equipment in good order, and use appliances only for their intended uses. Notify us as soon as possible of any issues with the cottage, its furnishings and equipment, or the grounds, needing maintenance, repair or replacement-—including anything damaged by you or your party. We will make every effort to correct any problems that arise in a timely manner, however we cannot guarantee against mechanical failure of cottage equipment.
Please, do not flush anything down the toilets that has not been eaten first, except toilet paper. The sewage system cannot digest anything else (no tampons or sanitary napkins, No paper towels or "Wet Ones," No baby wipes, No dental floss, No diapers, No cigarettes).
We reserve the right to enter the cottage at any time to investigate disturbances, check occupancy, check damages, or make repairs, alterations, and improvements.
Harborfields provides, at no charge, one or more rowboats for use by guests, clearly marked as such. Users of our rowboat(s) are required to bring in the boat with them at least one lifejacket for each person in the boat; children under 13 should be wearing their lifejackets (a selection of lifejackets is available in the dock box). All other boats at the dock are the private property of their owners and are not to be boarded without permission.
LIMITATIONS
Children under the age of 13 should be accompanied on the dock by an adult, and should also consider wearing a life-jacket (available in the dock box). No lifeguard is provided at the dock or elsewhere along the Harborfields shore.
Wireless internet service (WiFi) is provided as a convenience, and there are many variable factors (for example, the weather) affecting the propogation of wireless communication signals, such that we cannot guarantee 100% reliable WiFi connectivity in any of the cottages. Harborfields has no responsibility for any content guests might view over the provided internet access.
Lots of things that might impact your stay at Harborfields are beyond our control, such as electric or water utility service interruptions, fishermen hauling traps early in the morning while playing loud music, road construction activities, or the weather. Harborfields can’t be held responsible for these kinds of things, however, we will do all that is reasonably possible to remedy any issue as quickly as possible.
Harborfields is not responsible for the loss of personal belongings or valuables of any guests.
The renter accepts all responsibility for the behavior of all members of their party (including any pets) as well as any additional visitors they might host. Harborfields reserves the right to immediately terminate this rental agreement if the occupants generate unreasonable noise or other disturbance in and around the cottage, or engage in activity prohibited herein.
I Accept responsibility.
The renter agrees to pay in whole the costs of repair or replacement due to any damages determined by Harborfields to be caused by willful misconduct or blatant misuse, as a consequence of intentional act(s), gross negligence, or willful and wanton conduct of the renter, member of the renter’s party, or visitors to the renter or the renter’s party, and all costs of recovery including attorneys’ fees and costs.
I Agree to pay for damages.
The renter acknowledges that boating, swimming, and other waterfront activities have an inherent risk of damage and injury, including the possibility of permanent disability, paralysis, or death. Guests and visitors using the dock, boats, swimming or exploring the shore do so entirely at their own risk. Harborfields, LLC, and its contractors, employees, and officers, will not be responsible for injury, including death, to any guest, nor for damages to any guest’s property, sustained as a result of use of these waterfront facilities.
I Acknowledge the risks.
The renter agrees on behalf of all members of the renter’s party and any visitors, to release, hold harmless, and indemnify Harborfields, LLC, its contractors, employees, and officers, from any and all liability or claims, including those of third parties, arising out of or in any way a result of any guest’s use of the cottages, equipment, grounds, waterfront facilities, or boats, to the fullest extent allowable by law.
I Agree to hold harmless.
Up to two pets are allowed with the payment of an additional fee of $100 and the adherence to the rules outlined below.
All pets shall be completely housebroken, well behaved, and pest free.
All pets must be up-to-date on rabies vaccinations and all other vaccinations, and should have received a topical flea and tick repellent application 3 days prior to arrival. Heartworm preventive is highly recommended.
Dogs shall always be under the control of their handler at all times, either on leash or under verbal command. Cats, well what can we say?
Pet handlers shall remove all pet waste from the grounds and deposit in a dumpster. Any accidents in the cottages or on decks shall be cleaned up by the guest as soon as possible.
Dogs shall not be left unattended in the cottages or elsewhere on the grounds for extended periods unless crated. Incessant barking cannot be tolerated; renters with barking dogs may be asked to kennel them elsewhere (with no refund of the $100 pet fee).
Pets should not be permitted on furniture and bedding.
I Agree to the terms of the pet addendum.
There is no charge for small boats such as kayaks or canoes stored on land when not in use. Boats stored at the dock or on a mooring are subject to additional charges.
Boats and boaters must be in compliance with all applicable safety equipment and other requirements of the United States Coast Guard and State of Maine. Boaters are encouraged to carry adequate liability insurance for their boat, as such coverage might not be provided by homeowners or other insurance policies.
The renter hereby gives permission to Harborfields, it contractors, officers, and employees, to board the renter’s boat(s), re-tie the boat(s), or move the boat(s) on the dock, from the dock to a mooring (or vice versa), or to another dock.
I give permission to handle my boat.
The renter acknowledges that Harborfields is not responsible for the security or safety of the renter’s boat(s) whether tied to the dock or a mooring.
I accept all risk of damages to my boat.
The renter acknowledges that boating, swimming, and other waterfront activities have an inherent risk of damage and injury, including the possibility of permanent disability, paralysis, or death. Renters and visitors using the dock, boats, swimming or exploring the shore do so entirely at their own risk. Harborfields, LLC, and its contractors, employees, and officers, will not be responsible for injury, including death, to any person, nor for damages to any person’s property, sustained as a result of use of these waterfront facilities.
I Acknowledge the risks.
The renter agrees on behalf of all members of the renter’s party and any visitors or guests of the renter’s party, to release, hold harmless, and indemnify Harborfields, Inc., its contractors, employees, and officers, from any and all liability or claims, including those of third parties, arising out of or in any way a result of any guest’s use of Harborfields’ cottages, equipment, grounds, waterfront facilities, or boats, to the fullest extent allowable by law.
I Agree to hold harmless.
